Gym Babii LLC – Luxury Tailored Programs

Effective Date: At purchase of provided services: 3-Month Plan, 6-Month Plan, Virtual Training Sessions.

1. Program Overview

Gym Babii LLC offers two premium fitness coaching services:
- 3-Month Exercise Plan – $300
- 6-Month Exercise Plan – $500

Each program includes:
- An initial consultation to assess your goals, history, and current fitness condition.
- A fully customized, non-AI-generated fitness program tailored to your specific needs.
- The option to add virtual training sessions or the Check-Ins Add On (see Section 4).

2. Refund Policy

All program purchases are final and non-refundable unless the Check-Ins Add On is purchased at the time of plan enrollment.

If the Check-Ins Add On ($100) is purchased:
- Client is eligible for a partial refund only at the first check-in (see Section 4).
- The “first check-in” is defined as a scheduled 20-minute call or email between the end of Week 4 and start of Week 5 of the plan.
- Refund amount:
  - 50% of the base plan cost
  - 50% of the Check-Ins Add On cost
- Refunds are issued to the original method of payment.
- No refunds will be processed after the first check-in window has passed.

Policy Visibility:
This policy is linked at checkout, and clients must affirmatively agree to it via a mandatory checkbox before completing any purchase.

3. Virtual Training Sessions

Virtual training sessions may be offered in addition to the base program. Terms include:
- Sessions are conducted by Johnny The Body Mechanic, unless otherwise notified in writing.
- Sessions must be mutually scheduled.
- Sessions are subject to a strict 24-hour cancellation policy:
  - Sessions canceled/rescheduled with less than 24 hours’ notice are forfeited.
  - Medical documentation is required for waived forfeitures.

Expiration & Extension:
- All virtual sessions expire 2 months from purchase date.
- Reminder emails will be sent prior to expiration.
- In case of medical inability to participate, sessions may be paused for up to 6 months.
- No grace period is provided for non-medical emergencies.

If Trainer is Unavailable:
- Sessions may be rescheduled with Johnny The Body Mechanic.
- Client may receive a refund for unused sessions.
- A substitute trainer may be offered (subject to client approval).

4. Check-Ins Add On

The Check-Ins Add On is an optional $100 service available for both the 3- and 6-month programs.

Includes:
- 20-minute check-ins via phone or email (as chosen by the client).
- Check-ins commence after Week 4 of the program and continue for the remaining program duration.
- The first check-in determines eligibility for a partial refund (see Section 2).

5. Health & Liability Waiver

By participating in any Gym Babii LLC program, you affirm and agree that:
- You are medically cleared by a physician to engage in physical activity.
- You assume all risks associated with fitness training.
- Gym Babii LLC and Johnny The Body Mechanic are not liable for any injuries, health complications, or physical damages resulting from participation.
- You understand that virtual coaching has limitations in assessing and correcting physical form, and you participate at your own risk.

We strongly recommend all clients seek approval from a licensed healthcare provider before beginning.

6. Age Requirement & Consent

- You must be 18 years or older, or
- Have documented parental/guardian consent.

Clients under 18 must:
- Enter their date of birth at registration.
- Participate in a virtual call with a parent/guardian.
- Submit a completed Minor Consent Form provided by Gym Babii LLC.

7. Trainer Substitution & Service Continuity

Johnny The Body Mechanic is the primary trainer for all services. However, in the event of:

- Extended unavailability (e.g., illness or emergency), clients may:
  - Reschedule sessions,
  - Request a refund for unused services, or
  - Accept a substitute trainer (if available and approved by the client).

Clients will be notified in advance and may opt out of substitute services.

8. Governing Law & Dispute Resolution

This Agreement is governed by and shall be construed under the laws of the State of New York.

- Clients agree to resolve any disputes through binding arbitration in New York County, NY.
- Gym Babii LLC complies with applicable consumer protection laws in all U.S. states.
- Clients from other jurisdictions may receive state-specific accommodations if required by local law.

9. No AI-Generated Fitness Plans

All fitness programs are human-authored and personally reviewed by Johnny The Body Mechanic or a certified trainer assigned by Gym Babii LLC. No artificial intelligence is used in program creation.

10. Agreement Acknowledgment

By purchasing or participating in any Gym Babii Luxury Tailored Program, you affirm that:
- You have read and understood these Terms and Conditions.
- You have had the opportunity to consult with a healthcare provider.
- You accept all associated risks and responsibilities.

These Terms and Conditions are subject to updates. Clients will be notified of material changes.
